Terms of Service

These Terms of Service (“Terms”) govern your use of MyPorch (“we,” “our,” or “us”) and the services available at myporch.app. By creating an account or using MyPorch, you agree to these Terms. If you do not agree, do not use the platform.
1. The Service
MyPorch provides software tools for cottage food producers and home bakers, including a hosted storefront, batch order management, online checkout, customer communications, and cottage food label generation. We are a software platform — we are not a party to any transaction between you and your customers, and we do not manufacture, sell, or distribute food products.
2. SMS and Text Messaging Programs
MyPorch offers optional text-messaging programs that provide information about orders placed with bakeries using MyPorch and, if separately requested and confirmed, marketing alerts about those bakeries. Use of any MyPorch text messaging program is also governed by the SMS Terms, which are incorporated into these Terms by reference. Messages identify MyPorch first and also name the relevant bakery (for example, “MyPorch for Sample Bakery”). The bakery named in a message uses MyPorch’s platform, but MyPorch operates and controls the SMS program, sending numbers, consent records, message templates, opt-out processing, and support procedures.
Separate programs and consent
MyPorch operates two separate SMS programs. The order-updates program provides transactional information about eligible orders you place with a particular bakery, including one pickup reminder per order. The marketing program provides new-batch and last-call alerts for a particular bakery. Consent to one program does not constitute consent to the other. Marketing messages begin only after you separately request them and reply YES to MyPorch’s confirmation request. Your consent is limited to the bakery and MyPorch sending number identified when you enroll; it does not authorize unrelated marketing or messages for other bakeries.
Voluntary participation
Participation in either SMS program is voluntary. Consent to receive automated text messages is not a condition of purchasing any property, goods, or services from MyPorch or a bakery using MyPorch. You may complete an order without enrolling in either SMS program.
Message frequency and charges
For the order-updates program, MyPorch sends no more than one pickup reminder for each eligible order. For the marketing program, message frequency varies based on when the bakery opens a batch or sends an eligible last-call alert. Each program sends up to 10 messages per month. MyPorch may also send a limited number of administrative messages necessary to confirm an enrollment or opt-out request. Message and data rates may apply according to your wireless plan. Your wireless carrier may impose other charges, taxes, or fees for sending or receiving text messages.
Automated messages
Messages may be sent through an automatic telephone dialing system or other automated technology. By enrolling, you expressly consent to receive the automated messages described in the disclosure presented to you. You also consent to MyPorch’s use of electronic records to document your enrollment, consent, confirmations, preferences, and opt-out requests.
Opting out
You may opt out at any time by replying STOP to the MyPorch number sending the messages. MyPorch also honors other reasonable requests expressing that you want messages to stop. A text-message opt-out revokes both order-update and marketing consent for that bakery’s MyPorch number. It does not automatically stop messages from a different MyPorch number associated with another bakery. You may use the MyPorch SMS preferences page to change an individual program preference when that option is available.
After an opt-out, you may receive one final message confirming that the request was processed. MyPorch will not send further messages from that number unless you enroll again through a current MyPorch opt-in process. Replying START or UNSTOP may restore carrier-level delivery, but does not by itself restore consent in MyPorch. After a prior opt-out, recurring messages resume only after you request the desired program again and reply YES to the new MyPorch confirmation request.
Help
Reply HELP to the MyPorch number for program information and support instructions. You may also contact MyPorch at hello@myporch.app. MyPorch SMS numbers are automated program numbers and are not monitored for conversational customer support. For questions about an order, use the bakery or MyPorch contact method provided with the order.
Delivery
Wireless carriers and messaging providers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission by your wireless carrier and network operator and is not guaranteed. MyPorch is not responsible for messages that are delayed, blocked, filtered, misdirected, or not received because of network availability, carrier action, device settings, an inaccurate or reassigned mobile number, or circumstances outside MyPorch’s reasonable control.
Your mobile number
By enrolling a mobile number, you represent that you are the subscriber or customary user of that number and are authorized to consent to messages sent to it. You agree to provide an accurate mobile number capable of receiving SMS messages. If the number is reassigned, deactivated, disconnected, or no longer belongs to you, you must update your MyPorch information, opt out, or notify MyPorch promptly at hello@myporch.app.
Bakery-owner use
MyPorch, not an individual bakery owner, operates the SMS programs described here. Bakery owners may trigger only the limited order and marketing events made available by MyPorch. Messages use MyPorch-controlled templates and bounded bakery information. Bakery owners cannot enroll a customer, create consent on a customer’s behalf, upload a list of purported SMS subscribers, or compose unrestricted message content. A bakery owner may remove a customer from a program when the customer asks to stop receiving messages, but may not restore or grant consent. MyPorch maintains the applicable consent records and processes SMS keywords, opt-outs, help requests, and sending controls.
Program changes
MyPorch may change, suspend, or discontinue an SMS program or its features. We may update these SMS terms as described in the “Changes to These Terms” section. A change will not expand an existing consent to cover a different message category, a different bakery, or unrelated marketing; MyPorch will obtain any new consent required by applicable law. If a program ends, MyPorch may send an administrative notice where permitted.

3. Accounts
Eligibility
You must be at least 18 years old and legally permitted to operate a food business in your jurisdiction to use MyPorch. By creating an account you represent that you meet these requirements.
Account security
You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify us immediately at hello@myporch.app if you suspect unauthorized access.
Accurate information
You agree to provide accurate information when creating your account and to keep that information current. Accounts created with false information may be suspended.
4. Cottage Food Compliance — Your Responsibility
MyPorch provides tools to help you operate within your state’s cottage food framework, including label generation with state disclaimer language. However:
- You are solely responsible for understanding and complying with the cottage food laws in your state, county, and municipality.
- You are solely responsible for obtaining any required permits, registrations, or licenses before selling food products.
- You are responsible for verifying that the label content generated by MyPorch — including ingredient lists, allergen statements, net weight, and disclaimer language — is accurate and complete for each product you sell.
- Cottage food laws change. While we make reasonable efforts to keep disclaimer language current, you should verify required label elements against your state’s official sources before each label run.
- MyPorch does not provide legal advice. Nothing in our platform or documentation constitutes legal advice about food law compliance.
5. Payments and Billing
Subscription plans
MyPorch offers free and paid subscription plans. Paid plans are billed monthly. Prices are listed on our pricing page and may be updated with 30 days’ notice. Continued use after a price change constitutes acceptance of the new price.
Payment processing
Subscription payments are processed by Stripe. You must provide a valid payment method to activate a paid plan. Subscriptions renew automatically until cancelled.
Stripe Connect
To accept payments through your MyPorch storefront, you must connect a Stripe account. Stripe’s terms and fees apply to all transactions processed through your storefront. MyPorch does not charge a transaction fee on storefront sales on paid plans.
Refunds
Subscription fees are non-refundable except where required by law. If you cancel mid-cycle, your plan remains active until the end of the billing period.
Free plan limits
The Free plan includes up to 10 orders per calendar month. When this limit is reached, your storefront stops accepting new paid orders until the next calendar month or until you upgrade.
6. Your Content
You retain ownership of all content you submit to MyPorch — product descriptions, photos, ingredient lists, and other bakery information. By submitting content you grant us a limited license to store, display, and use that content solely to operate and provide the platform to you and your customers.
You represent that you have the right to submit any content you provide and that it does not violate any third-party rights.
7. Acceptable Use
You agree not to:
- Use MyPorch to sell products that are illegal in your jurisdiction
- Misrepresent your products, ingredients, or allergen information
- Use the platform to defraud customers
- Attempt to access another user’s account or data
- Reverse engineer, scrape, or otherwise extract data from the platform
- Use the platform in any way that disrupts its operation or security
- Violate any applicable law or regulation
8. Intellectual Property
The MyPorch platform, including its design, code, trademarks, and content we create, is owned by MyPorch and protected by intellectual property laws. These Terms do not grant you any right to use our trademarks, logos, or brand elements without our written permission.
9. Third-Party Services
MyPorch integrates with third-party services including Stripe, Supabase, and Google. Your use of these services is governed by their respective terms and privacy policies. We are not responsible for the practices or availability of third-party services.
10. Termination
By you
You may cancel your account at any time from your account settings. Cancellation stops future billing but does not entitle you to a refund for the current billing period.
By us
We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or pose a risk to other users or the platform. We will provide notice where reasonably possible, except in cases of serious violations.
Effect of termination
Upon termination, your access to the platform ends. We will retain your data in accordance with our Privacy Policy. You remain responsible for any outstanding payment obligations.
11. Disclaimers
MyPorch is provided “as is” and “as available” without warranties of any kind, express or implied. We do not warrant that the platform will be uninterrupted, error-free, or free of harmful components. We do not warrant the accuracy of any cottage food law information, label content, or regulatory guidance provided through the platform.
12. Limitation of Liability
To the maximum extent permitted by law, MyPorch and its officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform, including but not limited to regulatory fines, food safety incidents, or lost revenue.
Our total liability for any claim arising from these Terms or your use of the platform is limited to the amount you paid us in the three months preceding the claim.
13. Indemnification
You agree to indemnify and hold MyPorch harmless from any claims, damages, or expenses (including reasonable attorneys’ fees) arising from your use of the platform, your products, your violation of these Terms, or your violation of any applicable law, including cottage food regulations.
14. Governing Law
These Terms are governed by the laws of the State of Washington, without regard to conflict of law principles. Any disputes will be resolved in the courts of Washington.
15. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on the platform at least 14 days before the changes take effect. Your continued use of MyPorch after the effective date constitutes acceptance of the updated Terms.
